Acceptable Use Policy

1. No Inappropriate Content or Users
This Acceptable Use Policy (“AUP”) describes rules that apply to any party (“Customer”) using any products and services (“Services”) provided by YakChat Ltd. and any user of any software application or service made available by Customer that interfaces with the Services (“End User”). The examples described in this AUP are not exhaustive. Customer is responsible for its End Users’ compliance with this AUP. If Customer or any End User violates this AUP, YakChat may suspend Customer’s use of the Services. This AUP may be updated by YakChat from time to time upon reasonable notice, which may be provided via Customer’s account, e-mail, or by posting an updated version of this AUP at https://www.YakChat.com/
Violations of this AUP, including any prohibited content or communications, should immediately be reported to info@yakchat.com. Customer agrees to immediately report any violation of this AUP to YakChat and provide cooperation, as requested by YakChat, to investigate and/or remedy that violation.
A User’s failure to comply with this Acceptable Use Policy constitutes a violation by Customer as determined in YakChat’s sole discretion (“Violation”), with each such failure constituting a separate Violation. A Violation of this Policy may result in suspension or termination of Service and/or termination of the Customer’s Agreement, as described below. Customer shall immediately notify YakChat if they know or have a reasonable suspicion that a User of the Services is using it in Violation of this Policy. Customer shall contractually require that all Users comply with this Acceptable Use Policy. Prohibited activities include, without limitation, the following:
1. No Inappropriate Content or Users
Do not use the Services to transmit or store any content or communications (commercial or otherwise) that is illegal, harmful, unwanted, inappropriate, objectionable, confirmed to be criminal misinformation, or otherwise poses a threat to the public. This prohibition includes use of the Services by a hate group or content or communications that originate from a hate group or are exploitive, abusive, or hate speech.
2. Prohibited Activities
Do not use the Services to transmit or store any content or communications (commercial or otherwise) that is illegal, harmful, unwanted, inappropriate, objectionable, confirmed to be criminal misinformation, or otherwise poses a threat to the public. This prohibition includes use of the Services by a hate group or content or communications that originate from a hate group or are exploitive, abusive, or hate speech.
Violations of Laws. Violating laws, regulations, governmental orders, or industry standards or guidance in any applicable jurisdiction (collectively, “Applicable Laws”). This includes violating Applicable Laws requiring (a) consent be obtained prior to transmitting, recording, collecting, or monitoring data or communications or (b) compliance with opt-out requests for any data or communications.
Interference with the Services. Interfering with or otherwise negatively impacting any aspect of the Services or any third-party networks that are linked to the Services.
Reverse Engineering. Reverse engineering, copying, disassembling, or decompiling the Services.
Falsification of Identity or Origin. Creating a false identity or any attempt to mislead others as to the identity of the sender or the origin of any data or communications.
3. No Service Integrity violations
Bypassing Service Limitations. Attempting to bypass, exploit, defeat, or disable limitations or restrictions placed on the Services.
Security Vulnerabilities. Finding security vulnerabilities to exploit the Services or attempting to bypass any security mechanism or filtering capabilities.
Disabling the Services. Any denial of service (DoS) attack on the Services or any other conduct that attempts to disrupt, disable, or overload the Services.
Harmful Code or Bots. Transmitting code, files, scripts, agents, or programs intended to do harm, including viruses or malware, or using automated means, such as bots, to gain access to or use the Services.
Unauthorized Access. Attempting to gain unauthorized access to the Services.
4. Data Safeguards
Customer is responsible for determining whether the Services offer appropriate safeguards for Customer’s use of the Services, including, but not limited to, any safeguards required by Applicable Laws, prior to transmitting or processing, or prior to permitting End Users to transmit or process, any data or communications via the Services.
5. Service and Country Specific Requirements
Additional requirements for specific Services, including any country specific requirements, are set forth at https://www.YakChat.com/ and apply solely to the extent Customer uses those specific Services.
6. Warning/Suspension/ Termination
In the event of a Violation, YakChat may, in its sole and absolute discretion, take any or all of the following actions:
(i) Warning. YakChat may issue a verbal, e-mail or written warning notifying the Customer of the Violation and the corrective action that must be taken. A warning may also provide that YakChat will suspend or terminate all or part of a Customer’s service in the event of any additional Violation;
(ii) Suspension. YakChat may suspend, with or without warning, all or part of a Customer’s Service and may condition restoration of such Service upon Customer affecting corrective action;
(iii) Termination. YakChat may, with or without warning, and with or without prior suspension terminate all or part of Customer’s service and may terminate Customer’s Agreement. The foregoing is not an exhaustive list of actions YakChat may take in the event of a Violation and suspension or termination of Customer’s Service is not an exclusive remedy and shall not affect any other rights YakChat may have under the Agreement. YakChat shall have no liability to Customer or Users in the event the Customer’s Agreement is terminated and/or a User’s service is suspended or terminated in accordance with this Policy.
7. Miscellaneous
Failure of YakChat to enforce this Policy or take any action with respect to a Violation shall not constitute a waiver of its right to enforce any other Violation. YakChat takes no responsibility for any material created or accessed via the Services and does not monitor, verify, warrant or validate the integrity, accuracy and quality of information it receives or transmits, but reserves the right to do so in the event it has a good faith suspicion that a User may have violated this Policy. YakChat will cooperate with appropriate law enforcement and government agencies, or other parties involved in investigating claims of illegal or inappropriate activity. YakChat reserves the right to modify this Policy at any time by communicating such modified Policy to Customer or by posting it on YakChat’s website at www.YakChat.com, effective upon posting.
